Notices of Assessment and Second Interim Payments
The Administrators have begun sending Notices of Assessment to eligible group members. The Notices set out how each group member’s compensation amount has been assessed and the proportion that will be paid as the second interim payment.
The Administrators have commenced making second interim payments, which will be paid periodically as compensation assessments are finalised by our team. We anticipate that most compensation assessments will be completed by mid-2026.
If you have not been requested to sign an authority, there is no need for concern. The Administrators will contact you if any further documentation or information is required to finalise your assessment. You do not need to contact our office unless requested to do so.
The Ethicon and Boston administrations are separate and operate under different terms. For this reason, the percentage of assessed compensation payable as the second interim payment differs between the two administrations. These percentages have been determined by an independent actuary, whose findings have been reported to the Court.
Compensation Handbook
The Administrators have prepared a Compensation Handbook to explain how group members’ compensation is assessed under the Settlement Scheme and to assist in answering common questions about the assessment process.
The Compensation Handbook is being distributed to group members together with their Notices of Assessment. Notices of Assessment are issued progressively as compensation assessments are finalised, and distribution will continue over the coming months.

Final Payment and Administrator’s Costs
The Administrators expect that a final (third) payment will be made to group members after repayments to government agencies and private health insurers have been completed. It is not possible to determine the amount of the final payment until this work is completed, which is expected to occur in mid‑2027.
The Administrators will continue to provide periodic updates as further information becomes available.
The Administrators’ costs will also be finalised at that time. These costs will be overseen by the Court and will only be approved if the Court is satisfied that they have been properly incurred and ought to be paid.
Case Management Hearing – 12 February 2026
There was a case management hearing before the Federal Court of Australia on 12 February. The Administrators provided an update to the Court on the status of the Administration, addressed some issues raised in correspondence and provided a timeframe for the completion of compensation assessments. The Administrators anticipate that the large majority of compensation assessments will be completed by 30 June 2026. The Administrators are sending Notices of Assessments to group members on a daily basis, as they are finalised.
Justice Lee has tentatively listed the Administrations for a case management hearing on 16 July 2026 and has requested the Administrators provide a written update to the court regarding the progress of the Administration by 30 June 2026. Following receipt of the Administrator’s report, if His Honour is satisfied of the Administration’s progress, he will vacate the case management hearing on 16 July 2026. Justice Lee advised that if group members wish to raise any issues with the Court about the Administration, that those issues can be raised directly by group members on 16 July 2026, rather than via communication to the Court.
